APOSTILLE IN BRAZIL

The Convention abolishing the requirement of legalisation for foreign public acts, known as apostille of the Hague Convention is an agreement by the Hague Conference on Private International Law (HCCH). The Convention determining the manner in which a document issued or certified by public authorities, in this case Brazil, can be certified to be valid in the other signatory countries. This certification is called "apostille" (in French, apostille).

 

The validation/apostille has value only between the signatory countries of the Hague Convention. Thus, if the country where you will use the document is not a signatory of the  convention, the legalization must be made at the Consulate of that country.

 

Therefore, starting from August 14, 2016, the consulates of the signatories will not legalize the document to be valid in another foreign country. Since then, the apostille will be done by Public Notaries validating the document made public in Brazil to be valid for any signatory of the Hague Convention.

 

Brazilian public documents issued by a public office or local authority will not be legalized in the consulates of the signatory countries and should be “apostilled”: certificates of civil registration acts (birth, marriage and death); certificates of notarial acts (public attorney, deed, will); judicial decisions (adoption, divorce, lower guard regulations, single statement (a), etc.); Document schools and universities, private statements; less travel authorization forms, consent forms to obtain lower passport, certificate life forms, etc.
